Bailey’s Boston Terriers – Puppy Purchase Agreement
This Puppy Purchase Agreement (“Agreement”) is entered into between Bailey’s Boston Terriers (“Breeder”) and the Buyer (“Purchaser”). By placing a deposit, submitting payment, or taking possession of the Puppy, the Purchaser agrees to all terms set forth below.
1. Health Guarantee & Breeder Liability
The Breeder guarantees that the Puppy is healthy at the time of sale and has received age-appropriate veterinary care, including vaccinations, deworming, and a wellness exam by a licensed veterinarian.
Once the Puppy has been paid in full and released to the Purchaser, all responsibility for the Puppy’s ongoing health transfers to the Purchaser.
The Breeder is not liable for any health conditions that arise after transfer of ownership—genetic, congenital, hereditary, developmental, environmental, or otherwise.
All future veterinary care and costs are solely the Purchaser’s responsibility.
2. Veterinary Care Requirements
The Purchaser agrees to:
Schedule a wellness exam with a licensed veterinarian within 72 hours of receiving the Puppy.
Maintain ongoing veterinary care, vaccinations, parasite prevention, and emergency services.
Provide proper nutrition, hydration, shelter, safety, and enrichment.
If breeding rights were not purchased, the Purchaser agrees to have the Puppy spayed or neutered no later than 1.5 years (18 months) of age.
Failure to complete the initial exam does not reinstate any breeder liability.
3. Deposit Terms
A non-refundable deposit is required to reserve a Puppy. Deposits are non-refundable for any reason, including but not limited to changes in circumstances, financial concerns, or inability to pick up the Puppy on the agreed date.
If the Breeder determines a Puppy is not suitable for placement, the Purchaser may choose a refund or transfer their deposit to a future litter.
Full payment is required prior to pickup, delivery, or release of the Puppy.
4. Ownership Expectations
The Purchaser agrees to:
Keep the Puppy primarily as an indoor companion pet unless breeding rights have been purchased.
Provide training, socialization, structure, and a safe, loving home environment.
Properly contain the Puppy (yard, leash, crate, etc.).
Never surrender, rehome, sell, or transfer the Puppy without written approval from the Breeder.
If breeding rights were not purchased, the dog will not be bred—intentionally or accidentally—and must be spayed or neutered by 1.5 years of age.
If neglect, abuse, unsafe living conditions, or contract violations occur, the Breeder reserves the right to reclaim the Puppy without compensation.
5. Breeding Rights Clause
Breeding rights are not included in the standard puppy price.
If the Purchaser desires breeding rights:
A $2,000 breeding rights fee must be paid before ownership transfer.
The dog may be bred no more than three (3) times in its lifetime.
Purchaser agrees to follow ethical and responsible breeding practices.
The Breeder may deny or revoke breeding rights prior to transfer if the dog is deemed unsuitable for breeding.
If breeding rights are not purchased, any litters produced constitute breach of contract, and the Breeder may reclaim the dog or seek compensation.
6. Microchip & Recovery Clause
All puppies from Bailey’s Boston Terriers are microchipped with the Breeder’s information registered at the time of sale.
The Purchaser agrees to the following microchip terms:
Upon taking the Puppy home, the Purchaser may add their information as the primary contact on the microchip registry.
The Breeder must remain listed as the secondary contact for the lifetime of the dog.
This protects the Puppy under the Breeder’s lifetime return guarantee.
If the Breeder is ever contacted as a result of the microchip being scanned—whether due to abandonment, surrender, stray status, or emergency—the Breeder will:
Travel anywhere in the United States to retrieve the dog at any point in its life.
This clause ensures that no Bailey’s Boston Terriers dog is ever left without a safe home.
7. Lifetime Return-to-Breeder Policy
If at any point during the dog’s life the Purchaser can no longer keep the Puppy, the Purchaser must notify the Breeder and allow the Breeder to take back or rehome the dog.
The Puppy may not be surrendered to a shelter, rescue, or unauthorized third party without written approval from the Breeder.
No refunds are provided for voluntary returns.
8. Agreement Acceptance
By paying a deposit, submitting final payment, or taking possession of the Puppy, the Purchaser agrees that they have read and accepted all terms of this Agreement and that the wellbeing of the Puppy is the highest priority.
